Marriage Under the Special Marriage Act in Ahmedabad

A civil marriage before the Marriage Officer — open to every religion and caste, with no conversion and no ceremony required.

Last reviewed: 12 Oct 2026

The Special Marriage Act, 1954 lets any two adults marry by a civil procedure, regardless of religion, caste or nationality. Neither partner has to change their religion, and no religious ceremony is required. It is the standard route for inter-religion couples and is also widely used by couples of the same religion who simply prefer a civil marriage.

Conditions for marriage

  • Groom at least 21 years old, bride at least 18 years old.
  • Neither partner has a living spouse.
  • Both are capable of giving valid consent.
  • The partners are not within the degrees of prohibited relationship listed in the Act.

The procedure, step by step

  1. Notice of intended marriage. Both partners sign the notice in the prescribed form and submit it to the Marriage Officer of the district where at least one of them has lived for at least 30 days immediately before the notice.
  2. Publication. The Marriage Officer enters the notice in the Marriage Notice Book and publishes it in the office. If a partner's permanent address is in another district, a copy is sent to that district's Marriage Officer.
  3. 30-day objection period. Anyone may object within 30 days, but only on the ground that a legal condition (age, existing spouse, consent, prohibited relationship) is not met. The officer must inquire into any objection.
  4. Declaration and solemnisation. After 30 days, the partners and three witnesses sign a declaration before the Marriage Officer, and the partners say to each other, in any language they understand, that they take each other as lawful husband or wife.
  5. Certificate. The officer enters the marriage in the Marriage Certificate Book, signed by both partners and the three witnesses. This entry is conclusive evidence of the marriage.

If the marriage does not take place within three months of the notice, the notice lapses and a fresh notice is required.

Registering a marriage that already happened

If you were married earlier by a religious or customary ceremony, the Special Marriage Act also allows that marriage to be registered with the Marriage Officer, after a 30-day public notice. This is useful for inter-religion couples who married in a ceremony first, and for couples who need a civil certificate for use abroad.

Where we add value

The two most common reasons a notice is rejected or delayed are residence proof that does not show 30 days in the district and mismatches between documents. We check both before filing, prepare the affidavits, handle any objection and coordinate the date with the Marriage Officer.

Frequently asked questions

Can a Hindu and a Muslim marry under the Special Marriage Act?

Yes. The Special Marriage Act is open to people of any religion. Neither partner needs to convert, and each keeps their own religion after marriage.

Is the 30-day notice compulsory?

Yes. Under the Act, the marriage can only be solemnised after 30 days from publication of the notice. Courts in some other states have questioned the publication of personal details, but the 30-day period itself still applies in Gujarat.

Which office do we apply to in Ahmedabad?

To the Marriage Officer for the district where at least one of you has resided for 30 days. We confirm the correct office and appointment process for your address.

Who can be a witness?

Any three adults with valid ID and address proof — friends, colleagues or relatives. They must be present on the day of the marriage to sign.
